Abstract

Modern day types of sitting (Majls) and its impact on Nikah: A Shariah and Research analysis Marriage is considered as legal and social contract in islam between men and women; there are certain integral conditions for religiously valid Islamic marriage (Nikaah) in sharia. One of the conditions is that proposal (eejaab) and acceptance (Qubool) should come in one sitting(majlis) it is also stipulated by the sharia scholars that witness shall also be present in the sitting of nikah. Keeping in view the aforementioned condition, validity of Nikah performed by using modern day modes of communications like mobiles phones, internet based software's, is debatable among Sharia scholars in this paper the concept of majlis in sharia, especially in the context of Nikah is briefly discussed. further the modern day means of majlis is also presented and basis of difference of opinion on the issue among sharia scholars is examined. Different methods recommended by sharia scholar are also studied. It is discovered that nikah on internet performed through wakala is preferable between the suggested method.
