Abstract

Food Industry has expanded its market by increasing its commodities and products from meat to beverages, fruits and vegetables. However the primary product of the food industry is meat so far. In Western slaughter houses the animals are stunned completely before cutting their throats. They are stunned through an identical procedure regardless of their healthiness and weakness. Different stunning methods are used i.e. penetrating captive bolt, electronarcosis and Gas stunning (Controlled Atmosphere Stunning). Irrespective of the physical condition of animal, same method is used by applying uniform amount of gas, electric current or bolt. Result of this same occurrence might be death of animal before slaughtering. Imam Abu Hanifa opines that Transitional life (حیات مستمرہ) is sufficient for lawful slaughter while Imam Malik, Shafi’I and Imam Ahmad bin Hanbal along with Imam Abu Yousuf and Imam Muhammad assert that Biological life (حیات مستقرہ) is necessary for a legitimate slaughter. There is no contradiction in definitions and conditions of a Biological life levied by science and Islamic Jurisprudence. However this is established that despite the weakness of an animal, the process of stunning does not cease its Transitional life, hence it will remain Halal after proper slaughtering. The article deals with these discussions and opinions of different Islamic scholars to comprehend the issue and Shariah rulings.
