Abstract

‘NUSHOOZ’ An Analytical Study in Shari’ah Perspective NUSHUZ is an Islamic term which means disobedience, rash and violent behavior, ill treatment of a man to his counterpart, women’s hatred toward his husband. It is derived from Qura’nic verse. Marriage bond is utmost important in Islamic society, harmony, pleasant attitude and mutual respect is encouraged to make this life peaceful and blissful. Nowadays marital discords are increasing speedily and recklessly, it resulted in family disaster. Among other causes of breakage one cause is generally the husbands beat their wives with the concept that they have right to punish them at petty reasons according to Islamic commandments while this right is bounded with restrictions. Allah al-Mighty allows a man to punish his wife in case of misconduct. It is necessary to consider that this word is used for both husband and wife, in broader sense it occurs when each counterpart does not pay his due duty. Islam orders a husband to consort his wife in good manners, bad attitude towards mate is never appreciated and this causes the discomfort in family life. Islam does not allow a man to be cruel to his wife unless she commits adultery and disloyalty. This paper will analyze limitations of each partner and through light on contemporary issues in this regard.
