Abstract

Children are a precious wealth of any nation. If this wealth is not protected by  "reform and civilization" and is left to waste, not only will the future of children be  destroyed, rather Socially, this nation will be bankrupt. As if the survival and future  light of any national civilization depends on its children. Therefore, every nation  focuses on the protection of its children to protect its permanent. But any nation The  concern of Islam cannot be greater than the concern of Islam. Because Islam is a  complete code of life. It guides in all areas of life. It provides such rules and  regulations for safety and protection, which is its own example. Then the coverage of  the laws from birth to adulthood is also fully covered in the Islamic Sharia. The  jurists have discussed extensively on these laws. There is also a section on  "penalties". Now the question arises that "are the punishments applied to these  children or not? If not, what is the reason?" If applicable, to what extent are they  applicable? What are the rulings about this in Islamic Shari'ah? What have the jurists  of the Ummah discussed on these rulings? Which of these Concepts and Theories is  Rajih? In order to bring out the answers to these questions, I decided to cover and  analyze these Concepts and Theories of the jurists to clarify of Rajih Theory.  Therefore, I have decided to write the article named "Jurisprudential opinions about  quantity of Criminally and Disciplinary Punishment for the Children".
