Concept of Rape and Punishment

Abstract

This article discusses the concept of rape and certain related questions; as to what is rape. What is its concept in different religious and secular teachings of the world and what sort of punishments are promulgated by them for this heinous crime. The study is basically aimed at indicating the evilness of rape and its Islamic punishments, answering the questions raised by so-called enlightened groups of society against the severeness of these punishments. The article has also analyzed in detail the punishments prescribed by the revealed religions before Islam and refuted the objections of those who are influenced by modern western civilization, which is more sympathetic towards the oppressor than the oppressed. It is explained by the same severe punishments were pronounced even by the religions and societies before Islam. It is also pointed out that man-made laws were only meant for perpetuating the rule of the power-seekers and not for the betterment of humanity. On the other hand, the fact that the severe punishments were in vogue in all the revealed religions and ancient civilizations, shows that they all considered rape as unnatural and harmful for the peace of society. The rape on one hand creates disturbance in the society, while on the other, destroys the sanctity of human genealogy. Islamic teachings, in this respect are practicable and complete in all aspects, which has elaborately mentioned its ugliness and damage for a society and also clearly determined the punishments, which if implemented in word and spirit, can go a long way in freeing the society from this menace.
