Abstract

Every political system has a Specific Criteria to appoint a ruler that which seeks to keep in check some specific abilities in an individual before vesting in him the power to rule and govern. In the Islamic political system, a leader is expected to be equipped with two characteristics that are expected to be dominantly evident in him more than others; trust and power, while in Democratic system, credibility and character are deemed to be overlooked and what seems to withhold decisive power is merely the number of votes a person is able to get. Article 62 was included in the constitution of Pakistan in order to overcome the aforementioned shortcoming, but unfortunately, even that does not appear to address the issue in its entirety rather it merely circumscribes it to the extent that it does not allow a criminal to be in a ruling position. On the contrary, Islamic system obliges both the appointee and those in authority to appoint to be capable of what they are assigned to do and seeks to keep in check certain qualifications in them before they are vested with power to rule or to appoint. This treatise details the criteria for the appointment of a ruler in the light of Qur'an, Hadith and the opinions of the scholars of highest repute in Islām.
